TUPE Redundancy Calculator

Your service with the old employer still counts. See what your full continuous service is worth compared with a service date wrongly reset at the transfer.

The rule in one sentence: under TUPE 2006, when a business or service transfers to a new employer, your continuous service transfers with you — so redundancy pay is based on your total service with both employers, not just the time since the transfer.

What TUPE protects

Continuous service

Your start date for redundancy pay, notice periods and unfair dismissal rights is your original start date, not the transfer date.

Existing terms and conditions

Pay, hours, holiday entitlement and contractual redundancy schemes transfer across broadly unchanged.

Protection from transfer-related dismissal

Dismissal purely because of the transfer is automatically unfair. Redundancy for a genuine economic, technical or organisational reason can still be fair.

The right to be informed and consulted

Both employers must inform and consult representatives before the transfer.

A common error worth checking. New employers sometimes calculate redundancy from the transfer date because that is when you appeared on their payroll. Check your redundancy statement shows your original start date.
This calculator applies the statutory formula to the combined service you enter. It is not legal advice. If you think your service date is wrong, raise it in writing with your employer and contact Acas on 0300 123 1100.
